Conflict Management as structured communication between autonomy and core legal order
Within the research framework of the Cluster of Excellence, our institute will focus on methodological and substantial questions as to the shape of the space between binding law on the one hand and the principle of autonomy (of state or individual actors) on the other hand. The contemporary paradigm shifts within the structures of conflict management in the German and European legal system, the economy and international peace processes will serve as the empirical background of our work. Analyzing the tension between autonomy and ius cogens we focus on the following research question: How does communication – especially in situations of conflict – need to be structured in terms of method and substance in order to constructively challenge existing borders of orders, but simultaneously respect the core values of society?
