Conflict Man­age­ment as struc­tured communication be­tween auton­o­my and core le­gal or­der

With­in the research framework of the Clus­ter of Ex­cel­lence, our in­stitute will focus on method­o­logical and substantial questions as to the shape of the space be­tween binding law on the one hand and the principle of auton­o­my (of state or individual actors) on the oth­er hand. The con­temporary paradigm shifts with­in the struc­tures of conflict man­age­ment in the German and Eu­ropean le­gal system, the econ­o­my and international peace processes will serve as the em­pirical background of our work. An­alyzing the ten­sion be­tween auton­o­my and ius cogens we focus on the fol­lowing research question: How does communication – especially in sit­uations of conflict – need to be struc­tured in terms of method and substance in or­der to constructively chal­lenge exis­t­ing bor­ders of or­ders, but si­multane­ously respect the core val­ues of society?
